STATE OF LOUISIANA v. SHARON LEANN JOHNSON


Appealed from Caddo Parish No. 380,858.

Before STEPHENS, THOMPSON, and ROBINSON, JJ.

ORDER

Appellant Sharon Leann Johnson was granted an out-of-time appeal by the district court on February 13, 2023. The appeal record lodged with this Court on July 13, 2023. A review of the record does not indicate that appellant has been appointed counsel to represent her on appeal or that the district court held a hearing on the issue of self-representation.

Accordingly, this matter is hereby remanded for determination as to Johnson's representation. Within 30 days of this order, the district court is hereby ordered to make a determination as to defendant's indigence. If the defendant is determined to be indigent, the Louisiana Appellate Project shall be appointed to represent Johnson on appeal. The district court shall cause the appellate record to be supplemented with duplicate certified copies of the transcript of any proceedings held and/or any rulings or orders arising therefrom within 40 days of this Court's order. Briefing delays are hereby suspended pending further orders of this Court.
