       PER CURIAM.

       This case is before us on a Clerk's transcript. Defendant was indicted, tried and convicted of violation of State Liquor Control Act, in violation of Section 123.3, 1954 Code of Iowa, I.C.A. He was fined in the amount of $500, and in default of the payment of said fine that he be imprisoned in the Polk County jail at hard labor one day for each $5 of said fine not paid, but not exceeding a total of one hundred days, as provided in Section 123.91, 1954 Iowa Code, I.C.A. and defendant was also assessed the costs of the action. From such judgment he has appealed.

       Finding no error in the record the judgment is affirmed.

       Affirmed.
