ORDER

It is ORDERED that the motion for leave to file a motion for leave to appeal as within time (M-358) is granted; and it is further

ORDERED that the motion for leave to proceed as indigent (M-359) is granted, limited to the filing fees in this matter only; and it is further

ORDERED that the motion for leave to appeal (M-360) is granted, in part, and summarily remanded to the Superior Court, Appellate Division for defendant to proceed as indigent, limited to the full waiver of filing fees in this matter only. The motion for leave to appeal is denied in all other respects, including the request for relief from the denial of assignment of counsel and transcripts at the public expense.
