STATE OF LOUISIANA v. ARMOND J. HULL


In Re: Armond J. Hull, applying for supervisory writs, 23rd Judicial District Court, Parish of Ascension, No. 36736. BEFORE: WELCH, CHUTZ, AND LANIER, JJ.

WRIT GRANTED. This matter is remanded to the district court to consider the merits of relator's application for postconviction relief, filed on April 30, 2018. Although we recognize that when the application was filed relator's appeal delays had not elapsed, there is no record of relator filing a motion for appeal in this court. Therefore, relator's conviction and sentence have become final under La. Code Crim. P. art. 914, and his only avenue for relief is through an application for postconviction relief. See La. Code Crim. P. art. 924.1.
