By order of October 21, 1998, the application for leave to appeal as cross-appellant was held in abeyance pending the decision in the instant case.

On order of the Court, the decision having been issued on June 9, 1999, 460 Mich. 1 (1999), the application for leave to appeal as cross-appellant is again considered, and it is DENIED as moot in light of this Court's remand of this case to the Court of Appeals for consideration of the other claims of error raised by defendant in his prior appeal that were not addressed in the Court's prior ruling.
