591 So. 2d 219 (Fla. Dist. Ct. App. 1991)

Opinion

No. 88-2249.

June 26, 1991.

Appeal of a non-final order from the Circuit Court for Broward County; Mark A. Speiser, Judge.

Robert A. Butterworth, Atty. Gen., Tallahassee, and Carol Cobourn Asbury, Asst. Atty. Gen., West Palm Beach, for appellant.

Richard L. Jorandby, Public Defender, and Anthony Calvello, Asst. Public Defender, West Palm Beach, for appellee.

We find the trial court erred in concluding the defendant was illegally stopped; therefore, we reverse and remand with direction to determine whether the subsequent search was legal.

HERSEY, C.J., and LETTS and GLICKSTEIN, JJ., concur.
