Following a new sentencing hearing, the trial court determined that the sentences should be served consecutively for an effective sentence of twenty-four years incarceration. The trial court's sentencing decision was affirmed on appeal. See State v. Kenneth Herring, No. M2001-00751-CCA-R3-CD (Tenn. Crim. App. at Nashville, Feb. 11, 2002), perm. to appeal denied, (Tenn. 2002).
