Appeal from a judgment of the Superior Court for King County, No. 09-1-04002-4, Michael Hayden, J., entered April 14, 2010.


Remanded by unpublished per curiam opinion.


Leonard Haywood appeals from the judgment and sentence entered after a jury found him guilty of first degree robbery. Although the State did not allege that Haywood was armed with a firearm for purposes of a sentence enhancement under RCW 9.94A.533(3)(a), the jury returned a special verdict form finding that Haywood was armed with a firearm during commission of the crime.

We accept the State's concession that although the trial court did not impose a firearm enhancement at sentencing, the case should be remanded to permit the trial court to enter an order vacating the special verdict finding that Haywood was armed with a firearm.

Remanded for further proceedings.
