STATE OF LOUISIANA, DEPARTMENT OF TRANSPORTATION & DEVELOPMENT v. JULIAN HAYS, AND PARISH OF EAST BATON ROUGE


In Re: State of Louisiana, Department of Transportation and Development, applying for supervisory writs, 19th Judicial District Court, Parish of East Baton Rouge, No. 733000.

BEFORE: WOLFE, HESTER, AND MILLER, JJ.

WRIT GRANTED WITH ORDER.

On review, we conclude the petition filed by the State of Louisiana, Department of Transportation and Development, against Julian Hays and Parish of East Baton Rouge complied fully with the requirements of the "quick taking" statutes, La. R.S. 48:441-460. Upon presentation of the petition, the trial court was required to issue an order directing that the amount of the estimate be deposited in the registry of the court and declaring that the property described in the petition has been taken for highway purposes at the time of the deposit. La. R.S. 48: 444. Accordingly, the trial court is hereby ordered to sign the order of expropriation within 24 hours of this ruling.
