Upon Defendant's Motion for Production of Transcripts — DENIED.


ORDER

1. On March 4, 2008, Defendant filed a motion for postconviction relief, which the court summarily dismissed on March 6, 2008. The motion was based on four grounds of relief, including ineffective assistance of counsel. The court found that the motion was procedurally barred under Superior Court Criminal Rule 61(i)(3).

2. On April 3, 2008, Defendant filed a Motion for Production of Transcripts. Defendant sought the transcripts "in order to present a complete record for appeal."

3. Transcripts for appeal, is a matter that can be raised with the appellate court. Meanwhile, there is nothing pending in this court that justifies using the public's resources to pay for transcripts.

4. For its purposes, the court obtained a transcript of the January 29, 2008 plea, habitual offender and sentencing proceedings, a copy of which will be sent to Defendant as a courtesy.

For the foregoing reasons, the Defendant's April 3, 2008 Motion for Production of Transcripts is DENIED.

IT IS SO ORDERED.
