Appellant, the State of Texas, by and through the District Attorney in and for Nueces County, Texas, has filed a motion for stay of proceedings in the above causes. On January 31, 2016, the trial court granted a new trial in trial court cause 14-CR-1557-A and a new trial on punishment in related cause 14-CR-1556-A.
The State has filed notices of appeal in both causes and has requested that all further proceedings be stayed pending disposition of its appeals. See TEX. CODE CRIM. PROC. ANN. art. 44.01(a)(3), (e) (West, Westlaw through 2015 R.S. 2015). The Court, having examined and fully considered the motions for stay of proceedings, is of the opinion that said motions should be granted. The motions for stay are hereby GRANTED, and the trial court's proceedings in each of these causes are hereby ordered STAYED pending disposition of the State's appeals.
