No. M2009-01168-CCA-R3-CD (Tenn. Crim. App. Jul. 21, 2011)

Opinion

No. M2009-01168-CCA-R3-CD.

Date: July 21, 2011.

MEMO

We are requesting publication of the above captioned opinion (M2009-01168-CCA-R3-CD). It was filed on November 29, 2010; our supreme court denied permission on April 14, 2011; and the mandate was issued on May 2, 2011.

The original opinion contained an error in the introductory paragraph. The first sentence of this paragraph originally read: "The defendants, Emmett Lejuan Harvell and Bardell Nelson Joseph, were both convicted of tampering with evidence, . . ." A corrected opinion has been entered, changing this sentence to read as follows: "The defendants, Emmett Lejuan Harvell and Bardell Nelson Joseph, were both convicted of the facilitation of tampering with evidence, a Class D felony, and simple possession of a Schedule VI controlled substance, a Class E felony." This is the only change made to this opinion, and it has no legal consequence to the opinion.

Thank you.
