STATE OF LOUISIANA v. RAYMOND HAMILTON
In Re: Raymond Hamilton, applying for supervisory writs, 19th Judicial District Court, Parish of East Baton Rouge, No. 09-14-1017. BEFORE: DRAKE, HOLDRIDGE, AND CHUTZ, JJ.
WRIT DENIED. The record of the Clerk of Court of East Baton Rouge Parish reflects the district court denied relator's "Motion to Surpress" (sic) as moot on April 1, 2016, at a hearing in which relator was also present and represented by counsel. The record reflects that the district court is proceeding toward disposition of relator's "Motion to Quash with Extreme Prejudice," Motion for Speedy Trial; and "Motion for Recusation Under LA C.Cr.P. Article 671(A)(1)," as the matter is set for status conference on July 12, 2016. Further, relator has been billed and arraigned for the charges at issue in his petition for a writ of habeas corpus. Therefore, a request for release under La. Code Crim. P. art. 701(B) is moot. See State v. Varmall, 539 So.2d 45 (La. 1989) (per curiam).
