APPEAL FROM THE FIRST CIRCUIT COURT, (CR. NO. 99-0573).
ORDER OF CORRECTION
The opinion of the court, filed on August 6, 2004, is corrected as follows (deletions are bracketed and additions are double underscored, where appropriate):
1. The circuit court case number on page 1 is corrected from Cr. No. 00-0573 to Cr. No. 99-0573.
2. The citation to State v. Bani on lines 8 and 9 from the top of page 17 is corrected so that the citation reads: Bani, 97 Hawai`i at [1266] 296, 36 P.3d at [296] 1266.
3. The citations to State v. Wallace and State v. Hoey in footnote 23, lines 1 and 2 from the bottom of page 19, are corrected so those lines read: 80 Hawai`i 382, 397 n. 14, 910 P.2d [504] 695, [523] 710 (1996) (quoting State v. Hoey, 77 Hawai`i 17, 36, 881 P.2d 504, [529] 523 (1994).
The Clerk of the Court is directed to incorporate the foregoing changes in the original opinion and take all necessary steps to notify the publishing agencies of these changes.
