STATE OF LOUISIANA v. ROBERT GUIDRY


In Re: Robert Guidry, applying for supervisory writs, 16th Judicial District Court, Parish of St. Mary, Nos. 16-198547 (Old #99-152059) & 06-170348. BEFORE: PETTIGREW, McDONALD, AND CALLOWAY, JJ.

WRIT DENIED. The failure of a defendant to say "I plead guilty" does not render an otherwise knowing, intelligent, and voluntary guilty plea invalid. See State v. Holden, 2009-1714 (La. 4/9/10), 32 So.3d 803, 804 (per curiam). See also United States v. Williams, 20 F.3d 125 (5th Cir. 1994). Furthermore, see this Court's actions in 2003 KW 1623, 2004 KW 0105 and 2005 KW 0485, wherein relator previously alleged a similar claim.
