STATE OF LOUISIANA v. ALBERT GRAYER


In Re: Albert Grayer, applying for supervisory writs, 21st Judicial District Court, Parish of Tangipahoa, Nos. 901428, 1000444, & 1-100333. BEFORE: GUIDRY, WELCH, AND THERIOT, JJ.

WRIT GRANTED. The trial court's ruling denying relator's motion to quash is vacated, and this matter is remanded for reconsideration. If it has not done so already, the trial court is ordered to appoint counsel for relator and to hold a hearing to determine whether charges pending against relator in docket numbers 901428, 1000444, and 1-100333, wherein bills of information were filed in 2009, 2010, and 2011, respectively, should be quashed as having prescribed. See La. Code Crim. P. art. 578. If the court grants the motion to quash, it shall order any detainers generated by the charges removed. See State v. Williams, 2001-1249 (La. 5/25/01), 792 So.2d 744.
