STATE OF LOUISIANA v. CLAUDE R. GRAVES, JR.


In Re: Claude R. Graves, Jr., applying for supervisory writs, 23rd Judicial District Court, Parish of Ascension, No. 36951. BEFORE: GUIDRY, THERIOT, AND PENZATO, JJ.

WRIT DENIED. The district court did not err in denying relator's application for postconviction relief. Louisiana Code of Criminal Procedure article 930.3 sets out the exclusive grounds that may be raised in an application for postconviction relief, and the article does not provide the basis for review of sentencing errors after the conviction. See State ex rel. Melinie v. State, 93-1380 (La. 1/12/96), 665 So.2d 1172 (per curiam). Additionally, relator's claims regarding his guilty plea and ineffective assistance of counsel appear to have been raised in this court in the first instance. Relator should first seek relief in the district court regarding those claims.
