THE STATE OF TEXAS, Appellant, v. MARCO ANTONIO GONZALEZ A/K/A MARCO GONZALEZ, Appellee.
On appeal from the 404th District Court of Nueces County, Texas.
ORDER OF ABATEMENT
Before Justices Contreras, Benavides, and Longoria
Order Per Curiam
This cause is before the Court because the supplemental reporter's record has not been filed. On February 22, 2017, this Court granted appellant's motion to supplement the reporter's record and directed the reporter to file the supplemental record on or before March 14, 2017. On March 10, 2017, the reporter requested an extension of time to file the supplemental record on the basis that the appellant had not made payment arrangements. The appellant filed a response indicating contacts have been made with the reporter concerning payment. Appellant states that once the reporter requests payment from the State for preparation of the supplemental reporter's record, the State will process the request immediately.
The Court looks with disfavor upon the delay caused by the reporter's failure to have filed the supplemental record in this matter. The court reporter, Gay Richey, is directed to prepare a supplemental reporter's record in this cause to include the testimony of the victim, and closing arguments of appellant and appellee. The supplemental record shall be filed with this Court within twenty days from the date of this order.
IT IS SO ORDERED.
