Opinion

No. 85-1004.

June 3, 1986.

Appeal from the Circuit Court for Dade County; Arthur I. Snyder, Judge.

Jim Smith, Atty. Gen., and Charles M. Fahlbusch, Asst. Atty. Gen., for appellant.

Bennett H. Brummer, Public Defender, and Marti Rothenberg, Asst. Public Defender, for appellee Fidel Gonzalez.

Sy Gaer, John Lipinski, Miami, for appellee Andres Sanchez.

Before HENDRY, NESBITT and JORGENSON, JJ.

This is a state appeal from a trial court order dismissing an information charging the defendants, Gonzalez, Sanchez, and Blanco, with sale or delivery of more than 400 grams of cocaine. The trial court dismissed the information because the state failed to produce a confidential informant. We reverse on the authority of State v. Rodriguez, 483 So.2d 807 (Fla. 3d DCA 1986), and cases cited therein.

Reversed and remanded for further proceedings.
