STATE OF LOUISIANA v. LEONARD GASTON


In Re: Leonard Gaston, applying for supervisory writs, 19th Judicial District Court, Parish of East Baton Rouge, No. 04-11-0431. BEFORE: GUIDRY, THERIOT, AND PENZATO, JJ.

WRIT DENIED. Relator's sentence falls within the ranges of both the harsher and more lenient penalty provision. Therefore, relator's avenue for relief, if he has not already done so, is by application to the committee on parole pursuant to La. R.S. 15:308(C). State ex rel. Esteen v. State, 2016-0949 (La. 1/30/18), 239 So.3d 233, 238 n.4 (per curiam).
