The STATE of Texas, Appellant v. Ruben GARZA, Jr., Appellee

From the 49th Judicial District Court, Webb County, Texas

Trial Court No. 2011CRJ000782-D1

Honorable Jose A. Lopez, Judge Presiding

ORDER

Appellee's brief was originally due November 4, 2013, but it was not filed. On November 8, 2013, we ordered the brief filed within ten days of our order. Appellee has filed a motion requesting a sixty day extension of time to file his brief.

We grant the motion in part and order appellee's brief due January 3, 2014 (sixty days after the original deadline). Counsel is advised that any request for a further extension of time must (1) show extraordinary circumstances, (2) advise the court of the efforts counsel has expended in preparing the brief, and (3) provide the court reasonable assurance that the brief will be completed and filed by the requested extended deadline.
