STATE OF LOUISIANA v. RODNEY FORTENBERRY
In Re: Rodney Fortenberry, applying for supervisory writs, 22nd Judicial District Court, Parish of St. Tammany, No. 88-CR-143187. BEFORE: HIGGINBOTHAM, THERIOT AND CHUTZ, JJ.
WRIT GRANTED WITH ORDER. Relator Rodney Fortenberry is an inmate in the custody of the Louisiana Department of Corrections. By correspondence dated June 18, 2016, relator made a written request to the Clerk of Court for Washington Parish, pursuant to the Public Records Law, La. R.S. 44:1 et seq., for the costs to copy certain documents related to the jury venire in his criminal proceeding. On writs, relator seeks review of the October 7, 2016 judgment which denied his public records request. We hereby grant the writ and vacate the October 7, 2016 judgment. We further order the matter remanded to the district court with instructions to forward relator's public records request to the Clerk of Court for Washington Parish for consideration as a request under the Public Records Law as provided in La. R.S. 44:31.1.
