Opinion

Case No. 96-01347

Opinion filed March 7, 1997.

Appeal from the Circuit Court for Polk County; Robert A. Young, Judge.

Robert A. Butterworth, Attorney General, Tallahassee, and Erica M. Raffel, Assistant Attorney General, Tampa, for Appellant.

James Marion Moorman, Public Defender, and Cynthia J. Dodge, Assistant Public Defender, Bartow, for Appellee.

The issue presented by this appeal has been previously considered and determined adversely to appellee in State v. Barnes, 21 Fla. L. Weekly D2515 (Fla. 2d DCA Nov. 27, 1996). We therefore reverse and remand on the authority and reasoning of Barnes.

CAMPBELL, A.C.J., and SCHOONOVER and WHATLEY, JJ., Concur.
