STATE OF LOUISIANA v. DONNIE E. DUKE


In Re: Donnie E. Duke, applying for supervisory writs, 19th Judicial District Court, Parish of East Baton Rouge, Nos. 09-11-0029 & 09-11-0217. BEFORE: PETTIGREW, DRAKE AND CHUTZ, JJ.

WRIT DENIED. The office of the Clerk of Court of East Baton Rouge Parish's records reflect that the district court acted on relator's motion for amendment of sentence on January 10, 2015. Thus, relator's request for mandamus relief regarding the motion for amendment of sentence is moot. Insofar as relator seeks mandamus relief for production of discovery, the indictment, and the bill of particulars, there is no record of a motion for production wherein relator specifically requested these documents. Relator should file a motion with the clerk of court of the district court in docket number 09-11-0029 before seeking relief from this Court.
