Appeal from the Circuit Court of Platte County, Missouri, The Honorable Abe Shafer, IV, Judge.

Jayne T. Woods, Jefferson City, MO, Counsel for Appellant.

Before: Harold L. Lowenstein, P.J., Thomas H. Newton, C.J. and James E. Welsh, J.

The State appeals the judgment dismissing the resisting arrest charge against Ms. Gail Daws. The trial court dismissed the resisting arrest charge because Ms. Daws had previously pleaded guilty in circuit court to the lesser-included traffic offense of failure to yield.
