We initially accepted jurisdiction of the Fifth District Court of Appeal's decision in Davis v. State, 95 So. 3d 340 (Fla. 5th DCA 2012), on the ground of certified conflict with Pallin v. State, 965 So. 2d 1226 (Fla. 1st DCA 2007). See art. V, § 3(b)(4), Fla. Const.
Upon further consideration, we have determined that we should exercise our discretion and discharge jurisdiction. Accordingly, we hereby discharge jurisdiction and dismiss review.
Oral argument, scheduled for Wednesday, December 3, 2014, is canceled.
No motion for rehearing will be entertained by the Court. See Fla. R. App. P. 9.330(d)(2).
