Upon Review of the Commissioner's Report and Recommendation as to Defendant's Motion to Dismiss - REPORT AND RECOMMENDATION ACCEPTED

Dear Counsel:

Commissioner Manning issued a "Report and Recommendation as to Defendant's Motion to Dismiss" on May 7, 2018, recommending, for the reasons set forth in that Report and Recommendation, that the Defendant's Motion to Dismiss be granted with prejudice.

The State did not file any written objection to the Commissioner's Report and Recommendation within 10 days of that Report pursuant to Superior Court Criminal Rule 62.

The Court hereby accepts in whole the recommendations made by the Commissioner.

Defendant's Motion to Dismiss is hereby GRANTED.
