STATE OF DELAWARE v. JOE F. COOPER, Defendant.


ORDER

This 30th day of May, 2012, upon consideration of Defendant's Motion for Postconviction Relief, the Commissioner's Report and Recommendation and the record in this case:

1) The Court referred this Motion to Superior Court Commissioner Mark S. Vavala pursuant to 10 Del. C. §512(b) and Superior Court Rule 62 for proposed findings of facts and conclusions of law.

2) The Commissioner has filed a Report and Recommendation that the Court deny Defendant's Motion for Postconviction Relief.

3) No objection to the Commissioner's Report and Recommendation has been filed by either party within the allowable time frame under Rule 62.

NOW THEREFORE, after careful and de novo review of the record in this action, and for reasons stated in the Commissioner's Report and Recommendations of January 20, 2012,

IT IS ORDERED that the Commissioner's Report, including its recommendation, is adopted by the Court. Defendant's Motion for Postconviction Relief is DENIED.

IT IS SO ORDERED.
