On motion for reconsideration. Motion granted to the following extent. The opinion announced on August 4, 2004, is modified as follows:

¶ 14 is modified to read as follows:

{¶ 14} Accordingly, we reverse the judgment of the court of appeals and remand the cause to the court of appeals for consideration of appellant's remaining assignments of error and further action not inconsistent with this opinion.
