The State has filed a motion to withdraw its appeal. The motion is signed by the attorney for the State. See Tex.R.App.P. 42.2(a); State v. Miles, 994 S.W.2d 410 (Tex.App.-Waco 1999, no pet.) (per curiam). Accordingly, the Court GRANTS the motion to withdraw and ORDERS the appeal DISMISSED and that this decision be certified below for observance.
