STATE of Louisiana v. De’Ondric CLARKS

Applying For Writ Of Certiorari, Parish of St. Mary, 16th Judicial District Court Number(s) 199380, Court of Appeal, First Circuit, Number(s) 2024 KW 0443.

PER CURIAM:

1Writ granted. It is well settled that a trial court’s "determinations regarding relevancy and admissibility should not be overturned absent a clear abuse of discretion." State v. Mosby, 595 So.2d 1135, 1139 (La. 1992). Here, a clear abuse of trial court’s great discretion in evidentiary matters is not apparent. Defendant will have an adequate remedy on appeal if convicted. The court of appeal’s ruling is reversed and the trial court’s ruling is reinstated. The matter is remanded for further proceedings.
