SUA SPONTE ORDER

This matter having been opened to the Court on the State's notice of appeal as of right and defendant's notice of petition for certification and petition for certification of the judgment of the Superior Court, Appellate Division, in A-002755-17; and

The Court, by order filed May 21, 2021, having denied defendant's petition for certification, while the State's notice of appeal as of right remains pending; and

The Court, on its own motion, having reconsidered defendant's petition for certification; it is

ORDERED that defendant's petition for certification is granted, limited to question three, which concerns whether defendant's rights under the Fifth Amendment were violated by the admission of evidence that defendant asked for a lawyer when the interrogating officer pressed him to exculpate himself.

The parties shall serve and file briefs, limited to this issue, on the following expedited, peremptory schedule: defendant's supplemental appellant's brief shall be served and filed on or before February 18, 2022, the State's supplemental respondent's brief shall be served and filed on or before February 28, 2022, and defendant's supplemental reply brief, if any, shall be served and filed on or before March 4, 2022. No further briefing or applications to participate as amicus curiae shall be accepted for filing.

The parties shall appear for oral argument, limited to this issue, during the session of March 28-29, 2022, at a time to be scheduled by the Clerk of the Court.
