In State of New York v. City of Yonkers, 14 Misc.3d 1229(A), 2004 WL 5213504 (S.Ct.West.Co.2004), the State of New York (hereafter, the “State”) brought an action against the City of Yonkers (hereafter, “Yonkers”), inter alia, for a permanent injunction compelling Yonkers to abate its discharges of untreated sewage into the Bronx River.
