Before the Court is appellant's September 17, 2020 motion for en banc consideration on remand. In the motion, appellant requests these cases be considered en banc on remand, and if that request is denied, that no member of the original panel be assigned to consider the cases on remand. Appellant's motion is DENIED.
We treat appellant's objection to the original panel as a motion to recuse Justices Partida-Kipness and Justice Carlyle. Because there is no basis for recusal, Justices Partida-Kipness and Carlyle declined to recuse themselves. The motion to recuse was then certified to and decided by the remaining Justices en banc. See TEX. R. APP. P. 16.3(b).
