STATE of New Jersey, Plaintiff-Respondent, v. Michael CANALES, Defendant-Movant.


ORDER

This matter having come before the Court on defendant's motion for leave to appeal from the trial court's order remanding him to detention pretrial; and

The Court having considered the submissions of the parties and the record in this matter, and for good cause appearing; it is

ORDERED that this matter is remanded for the trial court to consider whether probable cause existed to charge defendant with first-degree racketeering, as opposed to second-degree, in the context of the motion for pretrial detention, and, if not, what impact the second-degree charge has on the court's detention decision; and it is further

ORDERED that the motion for leave to appeal is denied. Jurisdiction is not retained.
