State v. Burton

Appellate Division of the Supreme Court of New York, Second Department
Oct 9, 2007
44 A.D.3d 785 (N.Y. App. Div. 2007)

Opinion

No. 2006-06845.

October 9, 2007.

Appeal by the defendant from a judgment of the Supreme Court, Westchester County (Molea, J.), rendered June 15, 2006, convicting him of assault in the first degree, upon his plea of guilty, and imposing sentence.

Jason M. Bernheimer, P.C., Katonah, N.Y., for Appellant.

Janet DiFiore, District Attorney, White Plains, N.Y. (Brian F. Fitzgerald, Richard Longworth Hecht, and Anthony J. Servino of counsel), for Respondent.

Before: Rivera, J.P., Krausman, Florio, Carni and Balkin, JJ., concur.

Ordered that the judgment is affirmed.

We have reviewed the record and agree with the defendant's assigned counsel that there are no nonfrivolous issues which could be raised on appeal. Counsel's application for leave to withdraw as counsel is granted ( see Anders v California, 386 US 738; People v Paige, 54 AD2d 631 [1976]; cf. People v Gonzalez, 47 NY2d 606).
