Opinion
No. 5909.
Decided December 30, 1969.
1. The issues presented were governed by State v. Schena, 110 N.H. 73.
George S. Pappagianis, Attorney General, Henry F. Spaloss, Assistant Attorney General, and Richard A. Hampe, Attorney (Mr. Hampe orally), for the State.
Edward E. Williams, for the defendant.
By indictment returned on September 23, 1968, the defendant was charged with sale of hashish on May 20, 1968, at Plaistow, to one Donald P. Bazin of Nashua, in violation of RSA 318-A:2. Following a plea of not guilty, the defendant's motions to quash the indictment; to require the State to furnish the names and addresses of witnesses to be called by the State; including "the name of a so-called juvenile informer"; and for leave to take oral depositions of all or any witnesses; were denied by the Trial Court (Morris, J.) on November 18, 1968, subject to the defendant's exceptions.
Since the motions and the arguments advanced in support thereof are identical with those considered in State v. Schena, 110 N.H. 73, 260 A.2d 93 decided this day, the issues presented are governed by the decision there reached.
Exceptions overruled.
