Dear Mr. Myers and Mr. Black:

It appears that the Supreme Court has acted on Mr. Black's appeal from his sentence on the violation of probation and it appears further that Judge Gebelein of this Court has ruled on Mr. Black's Motion for Post-Conviction Relief.

I note for the record that Mr. Black has filed a memorandum in support of his Motion for a New Trial (Dkt. No. 61) and a more recent supplemental memorandum entitled "Motion to Amend Memorandum" (Dkt. No. 62). Mr. Black supplied the Attorney General with copies of both of these documents.

The Court lifts the stay that was entered by my Letter Opinion dated October 6, 1999 and the Court request that the State respond to the Motion for New Trial under Rule 33 (Dkt. Nos. 53 and 54) not later than March 31, 2000. IT IS SO ORDERED.
