Robert Stephen Tew Counsel for: State of Louisiana

Before STEPHENS, MARCOTTE, and ELLENDER, JJ.

WRIT DENIED.

The applicant, Jorge Lopez Benavides, requests this Court to issue an order directing the trial court to rule on his motion for extension of time to file an application for post-conviction relief and the memorandum in support allegedly filed on or about March 12, 2024, and June 6, 2024, respectively. Benavides has failed to include a copy of the motions at issue. U.R.C.A. 4-5(C). Nevertheless, the Ouachita Parish Clerk of Court's website shows that the trial court denied the motion and memorandum in support on September 9, 2024. Accordingly, the request for mandamus is denied as moot.
