Appellant having moved for permission to proceed as a poor person on the appeal taken herein from a decision of the Supreme Court entered in the Office of the Clerk of the County of Niagara on November 7, 2011,

Now, upon reading and filing the affidavit of Michael Bass sworn to January 30, 2012, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is denied with leave to renew upon making a new motion including in addition to all other necessary papers, a notice of appeal from an order or judgment and an affidavit of service thereof (see CPLR 5512 [a]; 22 NYCRR 1000.13 [a] [5] [i]).
