Opinion

80 N.W.2d 749 (Iowa 1957) STATE of Iowa, Appellee, v. Deo Dean BAKER, Appellant. No. 49132. Supreme Court of Iowa. February 5, 1957

Theodore F. Mantz, of Des Moines, for appellant.

Norman A. Erbe, Atty. Gen., Freeman Forrest, Asst. Atty. Gen., for appellee.

       PER CURIAM.

This case comes to us on a Clerk's Transcript.

On the 18th of June, 1956, the Grand Jury of Polk County, Iowa returned an indictment against the defendant Deo Dean Baker, accusing him of the crime of uttering and drawing a false check, as defined in Section 713.3 of the 1954 Code of Iowa, I.C.A., for $20 upon the Peoples Trust and Savings Bank at Lacona, Iowa, and delivering the same to Marjorie E. Dunley, for the purpose of securing said sum of money from her, knowing he did not have any arrangement, understanding or funds with such bank sufficient to meet or pay said check. On his plea of not guilty a trial was had to a jury which returned a verdict of guilty as charged, upon which judgment was rendered and entered sentencing defendant to the payment of the costs in the case and to commitment in the Iowa State Penitentiary at Fort Madison, Iowa, for a period of seven years. Defendant has appealed.

We find no error and the judgment is therefore affirmed.
