STATE OF LOUISIANA v. PAUL BAKER


In Re: Paul Baker, applying for supervisory writs, 19th Judicial District Court, Parish of East Baton Rouge, No. 12-14-0142. BEFORE: McDONALD, McCLENDON, AND WELCH, JJ.

WRIT DENIED. The record of the Clerk of Court of East Baton Rouge Parish reflects there is no record of a Petition for Writ of Habeas Corpus. However, relator has been billed, pled guilty, and sentenced for the charge arising from his October 28, 2014 arrest. Therefore, a request for release under La. Code Crim. P. art. 701(B) is moot. See State v. Varmall, 539 So.2d 45 (La. 1989) (per curiam). Further, the record of the East Baton Rouge Parish Clerk of Court's Office reflects on May 23, 2016, the district court denied relator's Motion for Modification of Sentence which was attached to but not mentioned in relator's writ application.
