STATE OF LOUISIANA v. JOSEPH ANDREWS
In Re: Joseph Andrews, applying for supervisory writs, 23rd Judicial District Court, Parish of Ascension, No. 33876. BEFORE: McDONALD, McCLENDON, AND THERIOT, JJ.
WRIT NOT CONSIDERED. Relator failed to comply with Uniform Rules of Louisiana Courts of Appeal, Rule 4-3 and 4-5(C)(11), by failing to include an extension of the return date order signed by the trial court. On December 23, 2015, the trial court gave relator until January 15, 2016, to file the instant application. The motion for an extension of time was not signed by the trial court. However, this application, filed on January 20, 2016, appears to be untimely. Additionally, in violation of Rule 4-5(C)(8) and (10), relator failed to include a copy of his bill of information and all pertinent minute entries. Supplementation of this writ application and/or an application for rehearing will not be considered. See Uniform Rules of Louisiana Courts of Appeal, Rules 2-18.7 & 4-9. In the event relator elects to file a new application with this Court, the application must be delivered to this Court on or before 12:00 p.m. on February 10, 2016, and comply with the rules for expedited consideration set forth in Rule 4-4. Any future filing on this issue should include the entire contents of this application, the missing items noted above, and a copy of this ruling.
