Upon consideration of the Motion for Order of Dismissal of Appeal, filed January 9, 2015, by Deputy Public Defender Taryn R. Tomasa (Counsel), court-appointed counsel for Defendant-Appellant Cory Andrade (Appellant), the papers in support, and the record, it appears that Appellant cannot be located after a diligent effort by Counsel and the Office of the Public Defender, and the appeal should be dismissed, pursuant to Hawai'i Rules of Appellate Procedure Rule 42(b) and (c).
Therefore, IT IS HEREBY ORDERED that the motion is granted and the appeal is dismissed.
