STATE OF MONTANA, Plaintiff and Appellee, v. CHARLES DAVID AMENT, Defendant and Appellant.


ORDER

Charles David Ament moves this Court to supplement the record with exhibits filed earlier this year in an original proceeding. The State has (has not) filed a response.

Ament requests that exhibits, numbered 19, 20, and 21, be filed with his instant . appeal. He states that the exhibits are "a handout of the State's evidence at trial in DC-22310. Ament provides that "[e]xhibit no. 19 is a picture of Jon Raymond's cut thumbf;] no. 20 is [his] name[,] and no. 21 is the seal of the State of Montana."

Ament presents no legal reason why these exhibits should be refiled in his appeal. This Court has authority to review a record of original papers, filed exhibits, and any transcript from the Flathead County District Court as well as the issues presented in the briefs. M. R. App. P. 8(1) and 12. If these exhibits are in the District Court's record, then this Court will have the opportunity to review them. Otherwise, these "exhibits" are not part of the record and cannot be refiled. Therefore, IT IS ORDERED that Ament's Motion to Refile Exhibits from OP 24-0117 in his appeal is DENIED. I

The Clerk is directed to provide a copy of this Order to counsel of record and to Charles David Ament personally.
