ORDER
Aloysius Dennis Black Crow moves this Court for appointment of counsel "to represent him with his Petition for post-conviction relief." As grounds, Black Crow states that he is currently incarcerated and cannot afford to retain counsel to represent him.
Black Crow appeals a December 7, 2022 Lake County District Court Order dismissing his petition for postconviction relief. The District Court points out that the petition was Black Crow's third one for postconviction relief.
Black Crow is not entitled to the appointment of counsel. He represented himself in the District Court. He has not demonstrated that extraordinary circumstances exist to justify appointment of counsel, pursuant to § 46-8-104(3), MCA. Accordingly, IT IS ORDERED that Black Crow's Motion for Appointment of Counsel is DENIED.
