STATE OF LOUISIANA v. JAMES R. AINSWORTH, JR.


In Re: James R. Ainsworth, Jr., applying for supervisory writs, 22nd Judicial District Court, Parish of Washington, No. 14-CR9-124266.

BEFORE: WHIPPLE, C.J., McCLENDON AND HIGGINBOTHAM, JJ.

WRIT DENIED. Relator has been billed and arraigned for the charges at issue in his motion to quash and his motion for immediate release. Therefore, a request for release under La. Code Crim. P. art. 701(B) is moot. See State v. Varmall, 539 So.2d 45 (La. 1989) (per curiam). Furthermore, on July 28, 2014, the trial court granted defense counsel's "motion to withdraw all pending motions filed pro se" in this case including relator's pro se motion for preliminary examination.
