This suit was consolidated for trial and appeal with the companion case of Pilcher v. Paulk et al., 228 So.2d 663, (La. App. 3 Cir. 1969) decided also on this date.

For the reasons assigned in the companion case, the judgment of the district court is affirmed at plaintiff's costs.

Affirmed.

On Application for Rehearing.


Counsel for appellee in the instant matter has called to our attention the fact that the costs of this appeal were taxed against appellee whereas they should have been taxed against the appellants. Counsel is correct.

The judgment of this Court is amended by taxing the costs of this appeal against appellants, and as amended, the rehearing is denied. The right of appellants to apply for further rehearing is reserved.

Rehearing denied.
