Mandamus — To require candidate's name placed on ballot — Election held — Moot question — Cause dismissed.

IN MANDAMUS.

Relator instituted this action in mandamus in this court seeking to require the respondent members of the board of elections to certify relator as a candidate for nomination at the primary election for the office of City Commissioner of Springfield and to order his name to be printed on the ballot to be used at the primary election.

Mr. Glenn E. Detling, prosecuting attorney, Mr. Henry R. Snyder and Mr. James A. Berry, for respondents.


The time for election having passed, the case has become moot and is dismissed on authority of Miner v. Witt, City Clerk, 82 Ohio St. 237, 92 N.E. 21.

Case dismissed.
