NO. 2013 CW 1021
2013-09-24
In Re: Watts Water Technologies, Inc., applying for
supervisory writs, 16th Judicial District Court,
Parish of St. Mary, No. 122717.
BEFORE: PETTIGREW, McDONALD AND McCLENDON, JJ.
WRIT NOT CONSIDERED. The writ application fails to comply with the Uniform Rules of Louisiana Courts of Appeal, Rule 4-5. Most importantly, relator violated the Uniform Rules of Louisiana Courts of Appeal, Rule 4-5(C)(8), by not including a copy of the declinatory exception of lack of personal jurisdiction on which the June 17, 2013 Judgment of the trial court is founded. Relator also did not attach the attachments to the opposing memoranda in violation of the Uniform Rules of Louisiana Courts of Appeal, Rule 4-5(C)(9), or the notice of intent and return date order in violation of the Uniform Rules of Louisiana Courts of Appeal, Rule 4-5(C) (11). In order for this Court to examine the trial court's ruling, it must be presented with the pleadings reviewed by the trial court, including the original declinatory exception, opposing memoranda with attachments and the notice of intent and return date order. Supplementation of this writ application and/or an application for rehearing will not be considered. Uniform Rules of Louisiana Court of Appeal, Rules 4-9 and 2-18.7. In the event that relator seeks to file a new application with this Court, it must contain all pertinent documentation and must comply with the Uniform Rules of Louisiana Courts of Appeal Rule 2-12.2. Any new application must also comply with the revision of the Uniform Rules of Louisiana Courts of Appeal, Rule 4-5. Any new application must be filed on or before October 11, 2013 and must contain a copy of this ruling.
